Be Cautious of Your Words When Recording Statements with the Authorities
Under section 32 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (“AMLA Act 2001”), section 30 of the Malaysian Anti-Corruption Commission Act 2009 (“MACC Act 2009”), and section 112 of the Criminal Procedure Code, authorities such as the MACC, the Police, and the Securities Commission Malaysia have the power to compel any person to furnish a written statement in the course of an investigation.
