We act as counsel in criminal appeals at all levels of the Malaysian courts, including the High Court, Court of Appeal, and Federal Court.
Our appellate work involves all range of matters arising from trial proceedings, as well as challenges to pre and post-trial decisions.
Scope of Work
We represent clients in: –
- Criminal appeals arising from convictions or acquittals;
- Application to strike out criminal charges due to being defective or did not disclose any offence;
- Appeals involving substantive errors of law, procedural irregularities, or misapprehension of evidence;
- Appeals raising constitutional issues and complex questions of criminal law;
- Interlocutory appeals and applications arising during criminal proceedings i.e., adducing fresh evidence;
- Appellate proceedings connected to regulatory and enforcement actions.
Our appellate practice focuses on: –
- Identifying and advancing substantive errors of law, procedural irregularities, interpretation of law, and misapprehension of evidence arising from trial proceedings;
- Advising on appeal strategy and prospects of success, and the formulation of focused and principled appellate arguments.
